The National Breast Cancer Foundation service and community networks (collectively, “NBCF”, or “the Service”) are operated by the National Breast Cancer Foundation, Inc., a Texas 501(c)(3) nonprofit corporation, and its corporate affiliates (collectively, “NBCF,” “us,” “we,” or “our”). These Terms of Service (“Terms” or “Agreement”) are an agreement between NBCF and you and govern your use of the Website (as defined below) and all information on or submitted through the Website. By accessing or using our Website at www.nationalbreastcancer.org, any sub domains or microsites, (collectively, “the Website”), or by posting a NBCF banner on your site, you (the “User”) signify that you have read, understand, and agree to be bound by these Terms of Service, in order to access and use the Service or the Website. We reserve the right, at our sole discretion, to change, modify, add, or delete portions of these Terms of Service at any time without further notice. For some areas of the Website, you may have to complete a registration process or create a profile. Completion of the process will usually create an account with a username and password or other identifier which you agree to guard as confidential information—if you are careless with it, others may be able to access the information. You agree to provide accurate, current, and complete information at all times. You agree that all uses of the identifier established for you during a registration or similar process will be attributed to and legally bind you and may be relied upon by us and our agents, affiliates, and other third parties with whom we work in order to provide the Website, Content, services, or pursue our mission (including but not limited to our and their respective affiliates, officers, employees and agents) (collectively “Third Parties”), as being a use made by you, even if someone else used your identifier.
Proprietary Rights in Site Content and Limited License
All content on the Website, including but not limited to designs, text, graphics, pictures, animation, video, information, software, music, sound, and other files, and their selection and arrangement (the “Site Content”), are the proprietary property of NBCF or its licensors with all rights reserved. The works of authorship contained on the Website, including but not limited to all design, text, and images (the “Materials”), are owned or licensed by NBCF or its affiliates and may not be copied, reproduced, transmitted, displayed, performed, distributed, rented, sublicensed, altered, stored by subsequent use, or otherwise used, in whole or in part, in any manner without our prior written consent. Unless permitted otherwise in writing, you may only access the Materials located within the Website for your personal use.
You understand that the Service and the Website are available for your personal, non-commercial use only. You represent, warrant, and agree that no materials of any kind submitted through your account or otherwise posted or shared by you through the Service will violate or infringe upon the rights of any third party, including copyright, trademark, privacy, publicity, or other personal or proprietary rights, or contain libelous, defamatory, or otherwise unlawful material. - solicit personal information from anyone under 18 or solicit passwords or personally identifying information for commercial or unlawful purposes;

- upload, post, transmit, share, store, or otherwise make available content that would constitute, encourage, or provide instructions for a criminal offense, violate the rights of any party, or that would otherwise create liability or violate any local, state, national, or international law;
- use or attempt to use another’s account, service, or system without authorization from NBCF, or create a false identity on the Service or the Website;
- upload, post, transmit, share, store, or otherwise make available content that, in the sole judgment of NBCF, is objectionable or which restricts or inhibits any other person from using or enjoying the Website, or which may expose NBCF or its Users to any harm or liability of any type.
User Content Posted on the Website
You are solely responsible for the photos, profiles, messages, notes, text, information, music, video, advertisements, and other content that you upload, publish, or display (hereinafter, “post”) on or through the Service or the Website, including social media or other online platforms, or transmit to or share with other Users (collectively the “User Content”). You understand and agree that NBCF may, but is not obligated to, review and delete or remove (without notice) any User Content in its sole discretion, including without limitation User Content that in the sole judgment of NBCF violates this Agreement or which might be offensive, illegal, or that might violate the rights, harm, or threaten the safety of Users or others. User Content shall include your name, picture, likeness, and voice.
By posting User Content to any part of the Website, including social media or other online platforms, you automatically grant, and you represent and warrant that you have the right to grant, to NBCF an irrevocable, perpetual, non-exclusive, transferable, fully paid, worldwide license (with the right to sublicense) to use, copy, publicly perform, publicly display, reproduce, reformat, translate, excerpt (in whole or in part), and distribute such User Content for any purpose on or in connection with the Website or the promotion thereof, to prepare derivative works of, or incorporate into other works, in any format or media (whether now known or hereafter created) throughout the world, such User Content, and to grant and authorize sublicenses of the foregoing. Mobile or Other Devices
Your carrier’s normal rates and fees, such as text messaging fees, will still apply. In the event you change or deactivate your mobile telephone number, you will update your account information on the Website within 48 hours to ensure that your messages are not sent to the person who acquires your old number.
You understand and agree that the information and materials on the Website, whether originating from NBCF, from postings and other User Content, or from Third-Party Content, are provided “as is” for general information only and without warranties of any kind. You further agree you will not upload, post, embed, transmit, share, store, or otherwise make available any content on the Website that offers, promotes, links to, advertises, or in any way solicits donations or contributions, whether in cash, goods, or in kind, for you or for any fundraising activity, charity, or other type of personal, private, or public entity, foundation, or organization. You understand and agree that any content deemed by NBCF to constitute a Personal Appeal or Third-Party Appeal may be removed without notice, and you further agree that NBCF is not responsible for any loss or damage resulting from the removal of such content. Any suspected Personal Appeal or Third-Party Appeals should be reported by contacting us.
You understand and agree that it is impractical for NBCF to monitor all postings and other User Content on the Website to ensure that it does not contain unauthorized Personal Appeal or Third-Party Appeals. Therefore, you agree not to use the Service to respond to any Personal Appeal or Third-Party Appeals that may be contained in a posting or other User Content on the Website, and that using the Service to respond to such Personal Appeal or Third-Party Appeals is a violation of these Terms of Service. Further, NBCF strongly recommends that you do not respond by other means to any Personal Appeal or Third-Party Appeals posted on the Website. Governing Law, Venue, and Jurisdiction

With respect to any disputes or claims not subject to arbitration (as set forth below), you agree not to commence or prosecute any action in connection therewith other than in the state and federal courts of Texas, and you hereby consent to, and waive all defenses of lack of personal jurisdiction and forum non conveniens with respect to, venue and jurisdiction in the state and federal courts of Texas.
YOU AND NBCF AGREE THAT THE SOLE AND EXCLUSIVE FORUM AND REMEDY FOR ANY AND ALL DISPUTES AND CLAIMS RELATING IN ANY WAY TO OR ARISING OUT OF THESE SITE TERMS OF SERVICE, THE WEBSITE, OR THE SERVICE (INCLUDING YOUR VISIT TO OR USE OF THE WEBSITE OR THE SERVICE) SHALL BE FINAL AND BINDING ARBITRATION, except that, to the extent that either party has in any manner infringed upon or violated or threatened to infringe upon or violate the other party’s patent, copyright, trademark, or trade secret rights, such other party may seek injunctive or other appropriate relief.
Arbitration under this Agreement shall be conducted by the American Arbitration Association (the “AAA”) under its Commercial Arbitration Rules and, in the case of consumer disputes, the AAA’s Supplementary Procedures for Consumer Related Disputes ( the “AAA Consumer Rules”) (collectively, with the AAA, the “AAA Rules”). The location of the arbitration shall be limited to Dallas, Texas and the allocation of costs and fees for such arbitration shall be determined in accordance with such AAA Rules and shall be subject to the limitations provided for in the AAA Consumer Rules (for consumer disputes). If such costs are determined to be excessive in a consumer dispute, NBCF will be responsible for paying all arbitration fees and arbitrator compensation in excess of what is deemed reasonable. The arbitrator’s award shall be binding and may be entered as a judgment in any court of competent jurisdiction.
To the fullest extent permitted by applicable law, NO ARBITRATION OR CLAIM UNDER THESE TERMS OF SERVICE SHALL BE JOINED TO ANY OTHER ARBITRATION OR CLAIM, INCLUDING ANY ARBITRATION OR CLAIM INVOLVING ANY OTHER CURRENT OR FORMER USER OF THE SERVICE, AND NO CLASS ARBITRATION PROCEEDINGS SHALL BE PERMITTED. In no event shall any claim, action or proceeding by you related in any way to the Website or the Service (including your visit to or use of the Website or the Service) be instituted more than three (3) years after the cause of action arose.
You agree to indemnify and hold NBCF, its affiliates, and each of their directors, officers, agents, contractors, partners, employees, and volunteers (collectively, the “NBCF Releasees”) harmless from and against any loss, liability, claim, demand, damages, costs, and expenses, including reasonable attorney’s fees, arising out of or in connection with any User Content, any Third-Party Content you post or share on or through the Website, your use of the Service, the Website, your conduct in connection with the Service or the Website or with other Users of the Service or the Website, or any violation of this Agreement or of any law or the rights of any third party.
You acknowledge and agree that any questions, comments, suggestions, ideas, feedback, or other information about the Website or the Service (“Submissions”), provided by you to NBCF are non-confidential and shall become the sole property of NBCF. NBCF shall own exclusive rights, including all intellectual property rights, and shall be entitled to the unrestricted use and dissemination of these Submissions for any purpose, commercial or otherwise, without acknowledgment or compensation to you.
These Terms of Service constitute the entire agreement between you and NBCF regarding the use of the Website or the Service, superseding any prior agreements between you and NBCF relating to your use of the Website or the Service. The failure of NBCF to exercise or enforce any right or provision of these Terms of Service shall not constitute a waiver of such right or provision in that or any other instance. If any provision of this Agreement is held invalid, the remainder of this Agreement shall continue in full force and effect. If any provision of these Site Terms of Service shall be deemed unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable from these Terms of Service and shall not affect the validity and enforceability of any remaining provisions.
